In Russia, people are punished for non-fulfillment of a prosecutor’s requirements
In April-May 2011, the Rostov Prosecutor’s Office for Supervision of Compliance with Laws in Correctional Institutions of the Rostov Region conducted a series of inspections of compliance with legislation on medical and sanitary provision for convicts and the accused held in custody by the administration of the Federal State Medical-Prophylactic Institution ‘Interregional Tuberculosis Hospital No. 19’ (MOTB-19) of the Main Directorate of the Federal Penitentiary Service of Russia for the Rostov Region.
As a result of the inspections, gross violations of criminal-executive and sanitary-epidemiological legislation were revealed, in connection with which four submissions on the elimination of legal violations were issued to the leadership of MOTB-19.
The responses received by the Prosecutor’s Office to three of the submissions did not contain information on the proper consideration of the prosecutor’s response acts, on measures taken to eliminate the violations and prevent them in the future, or on the punishment of the guilty officials. In addition, one response was submitted in violation of the one-month deadline.
In connection with the intentional non-fulfillment of the legal requirements of the prosecutor, the Rostov Prosecutor’s Office for Supervision of Compliance with Laws in Correctional Institutions of the Rostov Region initiated cases of administrative offense against the head of MOTB-19, as provided for by Art. 17.7 of the Code of Administrative Offenses of the Russian Federation. By a magistrate’s decision, the head of MOTB-19 was found guilty of committing the specified administrative offenses. She was sentenced to an administrative fine of 2,000 rubles for each case.
