DECREE OF THE PRESIDENT OF UKRAINE

On the formation of the State Department of Ukraine
for the Execution of Sentences

With the aim of further improving the management of the penal system, creating prerequisites for its reform and subsequent removal from the Ministry of Internal Affairs of Ukraine,
I DECREE:
1. To form the State Department of Ukraine for the Execution of Sentences as a central body of executive power on the basis of the Main Directorate for the Execution of Sentences of the Ministry of Internal Affairs of Ukraine, which is being liquidated.
To establish that the State Department of Ukraine for the Execution of Sentences is the legal successor of the Main Directorate for the Execution of Sentences of the Ministry of Internal Affairs of Ukraine regarding its obligations, rights, and duties.
2. To appoint Ivan Vasylovych SHTANKO as the Director of the State Department of Ukraine for the Execution of Sentences.
3. The Cabinet of Ministers of Ukraine shall:
submit proposals within a three-month period regarding the reform of the penal system;
submit draft laws and approve other regulatory legal acts regulating the activities of the bodies of the penal system to the Verkhovna Rada of Ukraine by 1 July 1998;
submit a draft Statute on the State Department of Ukraine for the Execution of Sentences within a two-month period;
provide for the allocation of centralized capital investments to the State Department of Ukraine for the Execution of Sentences for the development of the penal system and the construction of housing for commanding staff of this Department’s bodies during the formation of annual draft State Budgets of Ukraine;
define the State Department of Ukraine for the Execution of Sentences as a state customer for the supply (procurement) of products, performance of works, and provision of services to meet the needs of defense and security.
4. This Decree enters into force from the day of its publication.
