How many parcels can a convict receive?
On 27 May 2008, the Constitutional Court of Ukraine published the decision (v010p710-08) adopted on 22 May of this year in the case concerning the constitutional petition of 101 people’s deputies regarding the compliance of points 1–4, 6–22, 24–100 of Section 2 of the Law “On the State Budget of Ukraine for 2008”.
The Constitutional Court of Ukraine declared points 36–100 of Section 2, “Amendments to certain legislative acts of Ukraine”, as not complying with the Constitution of Ukraine; that is, points 70 and 71 of the Law “On the State Budget of Ukraine for 2008” regarding the wording of Article 112 of the Criminal Executive Code of Ukraine, namely in the part concerning the unlimited right of convicts to receive parcels, deliveries, and small packages, were deemed unconstitutional.
According to Part 2 of Article 152 of the Constitution of Ukraine, laws, other legal acts, or their individual provisions that are found to be unconstitutional lose their validity from the day the Constitutional Court of Ukraine adopts a decision on their unconstitutionality.
Thus, from the day the Constitutional Court’s decision of 22 May 2008 was published, convicts in minimum-security correctional colonies have the right to receive 7 parcels (deliveries) and 4 small packages per year; at medium security levels – 6 parcels (deliveries) and 4 small packages; at maximum security levels – 5 parcels (deliveries) and 2 small packages; life-term prisoners – 2 parcels (deliveries) and 2 small packages, and detainees may receive parcels and deliveries in accordance with paragraph 5 of Part 1 of Article 9 of the Law of Ukraine “On Pre-trial Detention”.
