Torez Correctional Colony (No. 28)
The State Institution “Torez Correctional Colony (No. 28)” was part of the structure of the State Penitentiary Service of Ukraine and ensured the enforcement of custodial sentences in accordance with the requirements of Ukrainian penal legislation. The institution was located in the Donetsk region and functioned for a long time as a correctional colony for the confinement of convicted persons.
The colony implemented measures for employment, vocational training, and social and educational work aimed at the resocialisation of inmates. In 2014, as a result of the armed aggression by the Russian Federation and the occupation of part of the Donetsk region, the State Institution “Torez Correctional Colony (No. 28)” ended up in the temporarily occupied territory of Ukraine.
Since that time, Ukraine has lost actual control over the institution and its property complex. Due to the temporary occupation, state authorities of Ukraine are deprived of the opportunity to manage the institution, monitor the conditions of confinement of inmates, and obtain reliable information regarding the current state of the facilities and the order of their use.
Thus, the State Institution “Torez Correctional Colony (No. 28)” belongs to the institutions of the State Penitentiary Service of Ukraine, which have been in the temporarily occupied territory of Ukraine since 2014.
In accordance with the Constitution of Ukraine and the Law of Ukraine “On Ensuring the Rights and Freedoms of Citizens and the Legal Regime on the Temporarily Occupied Territory of Ukraine”, the territory where the institution is located is an inalienable part of Ukraine, and state property remains the property of Ukraine regardless of the actual control over it.
